1. Acceptance of Terms
By accessing or using Art & Ruin (accessible via artandruin.com and associated applications or services), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not access or use the service.
The service is owned and operated by Skoolafix Limited, a company incorporated in the Republic of Kenya.
2. The Service
Art & Ruin is a digital interactive game and cultural media platform. We may offer both free and optional paid subscription or membership tiers. We reserve the right to modify, suspend, or discontinue any feature, content, or part of the service at any time, with or without prior notice.
We do not warrant or guarantee that the service will always be available, uninterrupted, error-free, or entirely accurate.
3. Accounts and Eligibility
You must be at least 16 years of age to register or use this service. If you create an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
We reserve the right to suspend, disable, or terminate accounts at our sole discretion for any violation of these Terms or for conduct that harms or threatens the integrity of the service or other users.
4. Subscriptions, Payments & Cancellations
If you purchase a paid subscription or feature:
- Subscriptions are billed on a recurring monthly or annual basis via authorized third-party payment processors.
- Subscriptions automatically renew unless cancelled prior to the end of the current billing cycle. You may cancel your subscription at any time via your account settings.
- Except where required by applicable laws of Kenya, all fees are non-refundable. Discretionary refund requests may be submitted to skoolafix@gmail.com.
5. User Conduct
You agree that you will not:
- Access, query, or interact with the service using automated means, including scrapers, bots, spiders, or unauthorized third-party scripts or extensions;
- Exploit bugs, technical vulnerabilities, or latency to gain an unfair advantage or manipulate scores;
- Impersonate any person or entity or misrepresent your affiliation;
- Harass, abuse, defame, or threaten other players in leaderboards, groups, or shared community features;
- Reverse engineer, decompile, or tamper with the underlying codebase or APIs;
- Use the service for commercial purposes without our express prior written permission;
- Use the service for any unlawful or unauthorized purpose under Kenyan law.
6. Leaderboards, Scoring, and Game Integrity
All determinations regarding gameplay mechanics, score calculations, leaderboard positions, moderation, and enforcement of these rules are final and made at our sole discretion.
We reserve the right to audit, adjust, or invalidate scores and suspend or ban accounts that we reasonably determine have engaged in cheating, botting, or score manipulation.
7. Intellectual Property
All software, visual design, game mechanics, questions, editorial copy, graphics, branding, trademarks, and content displayed on or made available through the service are the exclusive property of Skoolafix Limited or its licensors. You may not reproduce, redistribute, republish, sell, or create derivative works from any part of the service without our prior written consent.
8. Third-Party Services and Links
The service may link to or integrate third-party services (such as authentication providers, payment processors, or analytics services). Skoolafix Limited does not control and is not responsible for the availability, content, or privacy practices of such third parties.
9. Disclaimer of Warranties
The service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Skoolafix Limited, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of or inability to use the service.
11. Dispute Resolution & Arbitration
Any controversy, claim, or dispute arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall first be submitted to informal, amicable resolution between the parties.
If unresolved within thirty (30) days, the dispute shall be finally settled by binding arbitration in Nairobi, Kenya, in accordance with the Arbitration Act (Act No. 4 of 1995 of the Laws of Kenya) or the rules of the Nairobi Centre for International Arbitration (NCIA). The proceedings shall be conducted in English by a single arbitrator agreed upon by both parties (or appointed in default by the NCIA). Nothing herein prevents either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction in Nairobi.
12. Governing Law and Jurisdiction
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of Kenya, without giving effect to any principles of conflict of laws. Subject to the arbitration clause above, the courts of competent jurisdiction located in Nairobi, Kenya shall have exclusive jurisdiction over any legal proceedings.
13. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
14. Changes to These Terms
We reserve the right to amend or update these Terms at any time. Material updates will be indicated by revising the “Last updated” date at the top of this page. Your continued use of the service following any modification constitutes your acceptance of the updated Terms.
